Rental Agreement for WNC Realty & Rentals Vacation Homes
BY MAKING A RESERVATION AND PAYMENT FOR ONE OF OUR LUXURY HOLIDAY HOMES IN WESTERN NORTH CAROLINA, YOU HAVE AGREED TO ABIDE BY THIS GUEST RENTAL AGREEMENT. ANY VIOLATION OF THIS AGREEMENT, YOUR STAY WITH US MAY BE CANCELED WITHOUT REFUND. THIS AGREEMENT MAY NOT BE TRANSFERRED OR ASSIGNED.
CANCELLATION POLICY:
If reservations are canceled MORE than two (2) months prior to arrival date, the rental charges collected will be refunded less the cancellation fee (exact amount is listed with each home).
If reservations are canceled LESS than two (2) months prior to arrival, the rental charges collected will NOT refunded. It is wise to purchase Trip Insurance.
All renters are financially responsible for the time reserved. A home that is unacceptable to the renter is considered a cancellation. There will be NO refunds for events beyond our control including weather, change of plans, acts of nature, power outages, fire, war, strikes, flooding, early departures, etc.
Transferring a reservation to another time or home is treated the same as a cancellation.
Travelers Insuranceprotects you from losses you may incur due to unforeseen circumstances such as unexpected health issues, death, severe inclement weather, jury duty, etc. We urge you to consider purchasing trip cancellation/interruption insurance. SECURITY DEPOSIT:
In most cases, the Security Deposit is waived for the Renter’s convenience. However, Renter will be held financially liable for damage to the rental property as well as extraordinary cleaning if needed and charges will be applied to Renter’s credit card on file.
Renter must leave the home in a clean, neat condition including dishes washed, all trash bagged & placed in outside trash can, outdoor grill cleaned, dirty sheets & towels placed in laundry area (we ask that you start a load of towels), furniture returned to original placement if moved, air beds deflated & put away, etc.
OCCUPANCY:
Renter agrees to limit the number of occupants to the number stated for each property. With some of our homes, the rates are determined by the number of guests; therefore, in those homes, additional guests will result in additional charges. The Renter is responsible for notifying us of the correct number of guests. The maximum number of guests in a home at any one time determines the rate for the entire stay. Children and infants are counted as guests.
No house parties, fraternities, weddings, receptions (weddings and receptions must have prior approval) or parties are allowed. We do not rent to students or groups of students. If such a group attempts to occupy one of our rental properties, all monies will be forfeited and individuals will be asked to vacate the property immediately.
Check in-time is no earlier than 4 PM and check out-time is no later than 10 AM. NO EARLY CHECK-INS OR LATE DEPARTURES! Doing so may incur an additional charge. It is further agreed that there is NO SMOKING allowed at the property. A minimum $250 fine will be charged to Rent’s credit card if this rule is not observed.
In consideration of our neighbors, we ask that there not be loud noise after 10 PM.
Illegal activities of any sort are prohibited in all WNC Realty & Rentals.
GAS LOGS in our FIREPLACES will be damaged if any paper or other materials are thrown into the fire. DO NOT THROW ANYTHING INTO THE FIRE! DO NOT ROAST MARSHMALLOWS OR FOOD OVER THE LOGS! Do not rearrange the logs as mis-alignment will damage them. The replacement cost of at least $700 will be charged to a renter who causes this damage.
We have found that massage or other oils permanently stain our high quality cotton sheets. If you choose to use these oils, please bring your own sheets.
Owner or owner's agents shall be allowed access to rental property as deemed necessary to protect and maintain the integrity, usefulness, and enjoyability of the property including minor and major repairs. Whenever possible, we will notify you of needed access.
Mechanical Failures: Renter agrees to notify owner if any maintenance issue occurs AS SOON AS POSSIBLE so we may attend to its repair. Owners are not responsible for mechanical failure such as, but not limited to, air conditioning, hot tub, television or appliance that fails to operate properly during your stay. These failures are beyond our control and no refund or rent reduction will be given. We will make every effort to have repairs done as quickly as possible during reasonable hours.
The owner is not responsible for any loss, theft, or damage of renters’ personal property or loss of cash from theft or any other occurrence during your stay in any vacation home and shall be held harmless.
ACCIDENTS/INJURIES:
Renter agrees to hold WNC Realty & Renals and/or Owner/Landlord harmless for any accident or injury whatsoever that may occur on the rental property during occupancy. North Carolina family vacations are meant to be fun and safe for the family. By choosing one of the places to stay in or near Asheville NC, RENTER ACKNOWLEDGES WAIVER OF LIABILITY for hot tub, bath tubs, children's playground equipment, fire pit, swimming pool, pond, lake, stream, creek all herein after called “special feature,” if so equipped or on the property. Renter shall ensure use in a safe manner at all times and that JUVENILE USE IS SUPERVISED BY AN ADULT.
The Renter understands there are special risks that may be present to children who are not carefully supervised, as well as the danger of any person using the special features for too long a time, or if a person has health risks, or if a person uses the special feature while intoxicated or using any kind of drugs or medication, or uses the special feature if pregnant. The Renter agrees to explain the risks of using the special feature to any guests he or she may have at the home and to be fully and solely responsible for any accidents his guest may incur.
The Renter understands the risks discussed above and agrees that he will assume all responsibility for himself and his guests for the consequences of those risks. The Renter agrees to waive any claim whatsoever against the Landlord and/or Agent for accidents or claims arising from use of special feature. The Renter agrees to indemnify Landlord and/or Agent for any claims made by Renter's guests arising from Renter's guest's use of the special feature. The Renter also understands and agrees that he/she is responsible and liable and will pay agent upon request for any damages that occur to the special feature and its support equipment through his or his guest's misuse and/or negligence, for example, but not limited to, walking on the hot tub cover or damaging the cover and/or liner, or allowing the water level to become too low, or causing water overflow inside the home.
Renters are responsible for the actions of their guests.
PET POLICY:
MAN'S BEST FRIEND IS WELCOME AT VACATION HOMES - ALL DOGS MUST BE PRE-APPROVED AT TIME OF BOOKING. (Sorry, cats are NOT allowed.) A pet rent will be charged if the dog is approved.
The Renter is held financially responsible for all physical damage such as chewing, scratching, flea infestation, etc. inflicted on the property by the presence of the pet. If extra cleaning is deemed reasonable due to the presence of a pet such as soiled furniture and/or flooring, hair on furnishings or bedding, the Renter will be held financially responsible and the credit card on file will be charged for the amount of the repair/recovery. We have a quality vacuum cleaner at the home for your use.
RENTER/PET OWNERS MUST AGREE TO THE FOLLOWING: · Dogs must be at least one (1) year old, be well-trained, house broken and details of breed must be given. · Dogs are not allowed on furniture or beds at any time. Any evidence of pets on furniture may incur extra cleaning fees. · Dogs may not be allowed to stay alone in the home without being crated. · If dog is bothersome, guests must be willing to kennel the pet. · All dogs are to be treated with a flea and tick repellent three (3) days prior to arrival and must be free of fleas and ticks at time of stay. · Please have their nails clipped to minimize scratches on flooring. Dogs must be leashed at all times when outside. · Dogs must be taken out only to specified areas away from the home, lawns & flower beds. · Do NOT allow dogs to dig in the yard. · Dog owners are responsible for cleaning up of any/all dog refuse. Dogs may NOT be bathed in our bath tubs, showers or sinks. · Any damages or extra cleaning to the house or its furnishings caused by a dog, including excessive pet hair, urine stains or odors, will be charged to the renter. · All items above are the sole responsibility of the pet owner. The home owners assume no responsibility for illness or injury that may incur to pets or be caused by them.

WNC Realty & Rentals PRIVACY POLICY IN COMPLIANCE WITH General Data Protection Regulation (GDPR) WNC Realty & Rentals (the “Company”) is committed to protecting the privacy of its users. This Privacy Policy (“Privacy Policy”) is designed to help you understand what information we gather, how we use it, what we do to protect it, and to assist you in making informed decisions when using our Service. Unless otherwise indicated below, this Privacy Policy applies to any website that references this Privacy Policy, any Company website, as well as any data the Company may collect across partnered and unaffiliated sites.
